Esafe Alliance Terms of Service

1. Acceptance of Terms

These Terms govern your use of Esafe Alliance's SaaS, FinTech, and workforce management platforms. By registering an account, you confirm:

• You are 18+ years old or have legal guardian consent.
• You comply with all local laws (Uganda, Kenya, EU, Gulf states, etc.).
• You provide accurate information and update it promptly.

2. Account Registration & Security

• Credentials: You are responsible for maintaining confidential login details. Notify us immediately of unauthorized access.
• Account Ownership: Business accounts belong to the entity listed. Disputes require government-issued proof.
• Termination: We may suspend/terminate accounts for violations, fraud, or inactivity (90+ days).

3. Permitted & Prohibited Uses

Allowed Uses

• Recruitment processing (agencies/workers).
• Secure financial transactions (Esafe Wallet).
• CRM automation for businesses.

Prohibited Uses

• Illegal activities (fraud, money laundering, human trafficking).
• Bypassing security (hacking, scraping, reverse engineering).
• Spam/commercial misuse (unauthorized marketing).
• Violating labor/financial laws (e.g., Saudi Arabia's Nitaqat or UAE's WPS).

4. Fees & Payments

• Subscription Fees: Billed monthly/annually. Auto-renew unless canceled.
• Esafe Wallet: Transaction fees apply. Chargebacks incur penalties.
• Taxes: You are responsible for VAT, GST, or withholding taxes.

Refund Policy:

• Non-refundable: Subscription fees, third-party costs.
• Wallet Balances: Refundable within 30 days of account closure.

5. Intellectual Property

• Ownership: Esafe Alliance retains rights to software, logos, and content.
• User Content: You grant us a license to use data for service delivery.
• Restrictions: No copying, reselling, or creating derivative works without permission.

6. Data Privacy

Our Privacy Policy governs data collection. By using the Services, you consent to:

• Biometric processing (fingerprints/facial recognition).
• Cross-border data transfers (GDPR SCCs apply).
• Third-party sharing for essential services (payment processors, hosting).

7. Limitation of Liability

Esafe Alliance is not liable for:

• Service interruptions beyond our control.
• Misuse of accounts by unauthorized users.
• Third-party actions (banks, recruitment agencies).
• Indirect damages (lost profits, data loss).

8. Dispute Resolution

• Governing Law: Ugandan law applies (for HQ disputes).
• Arbitration: Mandatory for claims over $10,000 USD.
• Class Action Waiver: Claims must be filed individually.

9. Changes to Terms

We may update these Terms with 30 days' notice via email or in-app alerts. Continued use constitutes acceptance.
